- Are willing to be employed full-time in an H-1B nonimmigrant status
- Are willing to be employed at a healthcare facility in a medically underserved area (MUA), a health professional shortage area (HPSA), or for a medically underserved population (MUP)
- Get a contract from a healthcare facilities in one of those areas
- Agree to start employment at the healthcare facility within 90 days of receiving the waver instead of the date your J-1 Visa expires
