How Much Time Will I Serve for a Felony - Carlos Gamino

By Carlos Gamino

Felonies are the most serious crimes in Wisconsin, and the penalties for them are harsher. If you’re convicted of a felony, you could end up doing time in prison and paying large fines.

Felonies are divided into classes in Milwaukee and elsewhere in Wisconsin. Each class comes with its own set of penalties.

How Much Time Will I Serve for a Felony?

Felonies are classified by letter, with A being the most serious and I being the least serious. (They’re all serious – it’s just that some, like murder, are more serious than others, like drug possession.)

Here’s a breakdown of the penalties you could be facing by felony type.

Class A Felony Penalties

Class A felonies are the most serious, and they include things like premeditated murder. If you’re convicted of a Class A felony, you could be imprisoned for life.

Class B Felony Penalties

Class B felonies are only slightly less serious than Class A felonies are, and they include things like first-degree sexual assault. If you’re convicted of a Class B felony, you could be imprisoned for up to 40 years (or more if this is your second offense of first-degree sexual assault, for example) and have to serve up to 20 years on extended supervision.

Class C Felony Penalties

Class C felonies can include things like arson, OWI homicides and second-degree sexual assault. If you’re convicted of a Class C felony, you can be put in prison for up to 25 years and sentenced to up to 15 years of extended supervision. You can also be fined up to $100,000.

Class D Felony Penalties

Class D felonies include things like child enticement. If you’re convicted of a Class D felony, the judge can send you to prison for up to 15 years and put you on extended supervision for another 10 years after that. He or she can also fine you up to $100,000.

Class E Felony Penalties

Class E felonies, which can include crimes like aggravated battery, can put you in prison for up to 10 years with an additional 5 years of extended supervision once you’re out. The judge in your case can also fine you up to $50,000.

Class F Felony Penalties

Class F felonies can include crimes such as pimping, and if you’re convicted, you could spend up to 7 years and 6 months in prison with an extra 5 years of extended supervision after you’re released. You may also have to pay fines of up to $25,000.

Class H Felony Penalties

Class H felonies can include theft, depending on the value of the property you’re convicted of taking. If you’re convicted of this type of felony, you could spend up to 3 years in prison with 3 years of extended supervision, and you could be fined up to $10,000.

Class I Felony Penalties

Class I felonies are the least serious felonies in the state, but if you’re convicted, you could be sentenced to up to 1 year and 6 months in prison with 2 years of extended supervision after you’re released. You could also have to pay fines of up to $10,000.
